General Terms and Conditions (GTC) for the online shop of BlüTech GmbH

1. Scope

1.1. The following terms and conditions apply to all contracts, deliveries and services between BlüTech GmbH (hereinafter referred to as “Seller”) and its customers via the online shop van-bike.com.

1.2. Any deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract, even if known, unless their validity is expressly agreed to in writing.

2. Conclusion of contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

2.2. By clicking on the button "Order with payment" the customer places a binding order for the goods contained in the shopping cart. The seller will immediately confirm receipt of the order by email.

2.3. The contract is concluded by the acceptance of the order by the seller, which occurs with a separate e-mail (order confirmation) or by delivery of the goods.

3. Prices and payment terms

3.1. The prices stated are final prices and include statutory sales tax and other price components. Additional delivery and shipping costs are stated separately.

3.2. The customer can pay by PayPal, credit card or advance payment by bank transfer. If advance payment is selected, the seller will provide the bank details in the order confirmation.

4. Delivery and shipping conditions

4.1. The delivery of goods takes place by shipping to the delivery address specified by the customer, unless otherwise agreed.

5. Right of withdrawal

8. Liability

8.1 The Seller shall be liable without limitation for damages resulting from injury to life, body or health resulting from a negligent breach of duty.

8.2. Otherwise, the seller is only liable if a material contractual obligation (cardinal obligation) has been violated. In this case, liability is limited to the damage that is typical for the contract and foreseeable.

9. Final provisions

9.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

9.2 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
